Halle Berry‘s son Maceo, 13, is ready to testify in court, according to his father.

New court documents in the former couple’s case say that the 60-year-old actress and ex-husband Olivier Martinez‘s teenage son wants to address the court in custody hearings to “provide his side of the story,” according to People.

“He should have the opportunity to have his voice heard regarding what he experienced that night,” Olivier wrote in the latest filing. “If he is prevented from addressing the Court regarding these allegations, I fear that he would be dissuaded from reporting problems or potential abuse in the future.”

He added that he expects Halle to try and “prevent our son from addressing the Court directly, as he explains Maceo‘s testimony will be “key to the Court learning the full truth about the events that occurred on September 26th.”

“I am the parent who wants the truth to come out. I am the parent who does not want to suppress Maceo’s voice,” Olivier shared in the docs. “To the extent that Petitioner attempts to prevent our son from speaking with a Judge regarding what happened, I fear this is an attempt to escape culpability for what occurred.”

The actor also says their son has expressed concern that no one believes him over his mother.

“He explained to me that he has complained to therapists in the past about his mother being physical with him, and that these people either downplay or dismiss his concerns,” Olivier claims. “He already feels that people are prone to take dismiss any concerns he has about Petitioner.”

What is going on between Halle Berry and Olivier Martinez?

This all started earlier this month when Olivier filed a temporary restraining order against Halle alleging that their son, Maceo, called him and told him she allegedly physically attacked him and put him in a chokehold.

The Oscar-winning actress reacted to the claims through her lawyer, saying the filing is “entirely meritless and deliberately misleading would be an understatement.” She also said her ex has repeatedly violated court orders, but says the filing was “not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behavior.”

Olivier requested sole custody of Maceo and wanted the court to force Halle to stay away from him and their son. He also asked that she must not drink or be under the influence of alcohol or other substances in the presence of their son, as well as undergo sobriety testing before, during or after any visitation.

The French actor’s temporary restraining order request against Halle was granted by a judge, covering both him and Maceo. However, the judge ordered a temporarily modified visitation, meaning partial custody is to be “continued to maintain communication between [Berry] and [Maceo].”

Olivier‘s request that Halle‘s sobriety be monitored was denied, though, as there was “insufficient information.”

The order modified Halle‘s visitation with Maceo, limiting her time with him to Mondays and Tuesdays between 10 a.m. and 8 p.m., and Saturdays and Sundays from 10 a.m. to 8 p.m.

The temporary restraining order will be in effect until a hearing later this month, where a judge will determine whether or not the order should be made permanent.

Halle‘s 18-year-old daughter Nahla, whom she shares with ex Gabriel Aubry, has submitted a declaration with the court, defending her mother.

“I never observed anything abusive about her parenting,” Nahla wrote in her declaration, per People, describing her mom as a “loving and devoted parent” who is “warm, supportive, and deeply involved,” and “can be strict when necessary and expects her children to follow rules and be respectful.”

Nahla said she has never seen her mother physically abuse Maceo in any way. She did note that while she has never seen her mom act violent toward anyone, she did claim that Olivier beat up her father, Gabriel, in their driveway when she was little.
