Halle Berry is pushing back against a photograph cited by ex-husband Olivier Martinez in their custody dispute.

The 60-year-old actress says the image does not support his allegations that she physically abused their 13-year-old son, Maceo. Halle has denied the abuse claims.

According to People, she filed a response on Tuesday (October 13) to Olivier‘s October 12 filing.

Olivier has requested sole custody of Maceo, alleging that Halle physically abused their son during a September 26 incident. She denies his account.

In his latest filing, Olivier said Maceo took a picture of his mother after the alleged incident.

However, Halle argues that the photograph shows her standing with her hands in her pockets, several feet away from their son. She also says there are no photographs showing injuries to Maceo that support Olivier‘s allegations, according to TMZ‘s reporting.

Halle also disputes his description of a statement from her fiance, Van Hunt.

“Van simply stated that he did not observe redness or bruising on Maceo,” her response says, per People. She argues that this is different from saying Van inspected their son for injuries.

The former couple also disagree about whether Maceo should testify at their custody hearings.

Halle has accused Olivier of coaching their son, while Olivier says Maceo wants the opportunity to give his account to the court. His lawyer has denied the coaching allegation and argued that their son should be allowed to testify.

“We vehemently deny such allegations,” Olivier‘s lawyer Patrick Baghdaserians told People.

Halle and Olivier separated in 2015 after two years of marriage. They finalized their divorce in August 2023, reaching a custody agreement at that time. In 2024, they agreed to co-parenting therapy.

Along with Maceo, Halle is also mom to daughter Nahla, 18, whom she shares with her former partner, model Gabriel Aubry. Just a few weeks ago, Halle spoke about Nahla going off to college.

Nahla also submitted a declaration defending her mother.
